Legal Senior Expert - CFTA Support Unit
The African Union, established as a unique Pan African continental body, is charged with spearheading Africa’s rapid integration and sustainable development by promoting unity, solidarity, cohesion and cooperation among the peoples of Africa and African States as well as developing a new partnership worldwide. Its Headquarters is located in Addis Ababa, capital city of Ethiopia.
In line with the BIAT/CFTA Decision of 2012, which was re-echoed by the 9th CAMOT in December 2014, the African Union Commission was charged with the responsibility to coordinate and provide overall guidance for the CFTA negotiations, as well as serve as the secretariat for the implementation process and for the High Level African Trade Committee (HATC). With this responsibility the Department of Trade and Industry was directed to strengthen its capacity in order to deliver on its mandate. In this regard, a CFTA Support Unit will be incorporated within the Department’s organogram to facilitate the CFTA negotiations. The proposed CFTA Support Unit will provide the critical foundation for productive and technical negotiations. It will allow significant challenges to be addressed in the run-up to the negotiations, allowing the AUC to collect Member State inputs and increase their buy-in. The CFTA Support Unit will also provide technical and negotiating assistance to countries that need them during the course of the CFTA negotiations. The CFTA Support Unit will also provide secretarial and technical support to the meetings of the various levels of the CFTA negotiations structure established by the Member States. Recruitment of CFTA Support Unit staff will be done in line with the AUC Rules and Procedures.
Job Purpose
The principal objective of this post is to facilitate and provide legal support to the various levels of the Member State-driven CFTA negotiations. The specific purpose of the post is to: provide appropriate legal advice to the negotiators involved in the various levels of the structure of the CFTA negotiations; manage short-term specialist legal studies and the presentation of their results; provide appropriate CFTA-related legal advice to the Chief Technical Advisor CFTA Support Unit; and provide secretarial support in collaboration with the Chief Technical Advisor CFTA Support Unit to the Member State committee tasked with negotiating and finalising the text of the Agreement (including keeping an up-to-date record of the status of each of the articles and annexes of the text). The incumbent will be responsible for providing input to the Chief Technical Advisor of the CFTA Support Unit on issues relating to the legal issues arising out of the negotiations for the unit’s periodic reporting requirements. The Incumbent will also work closely with the AU Office of the Legal Counsel.

2. Main duties and responsibilities
The incumbent will:
• Provide legal advice on CFTA issues raised by Member State representatives participating in meetings at the various levels of the CFTA negotiations structure;
• Manage short-term legal experts to undertake subject-specific research into legal issues raised by Member State representatives participating in meetings of the CFTA negotiations structure. The incumbent will ensure the appropriate and timely dissemination of the results and recommendations of this research to the Member State representatives. Where appropriate this duty may be delegated to the short-term legal expert(s) commissioned to undertake this specialist research;
• Provide appropriate legal advice to the Chief Technical Advisor CFTA Support Unit and the Director of Trade and Industry;
• Collaborate closely with the Office of the AU legal Counsel in the in the discharge of his/her duties;
• Maintain and disseminate an up-to-date record of the status of all chapters and annexes of the text;
• Assist Member States with the “legal scrubbing” of the text and annexes once they have been finalized;
• Assist the Chief Technical Advisor CFTA Support Unit in providing secretarial support to the CFTA negotiations committees (Member States’ i) chief negotiators and ii) Ministers) that will negotiate and approve the text and annexes of the agreement. This assistance may include contributing to the production of the minutes of meetings, the dissemination of relevant legal documentation to participants, and the provision of legal advice;
• Produce the required inputs on work done on CFTA legal issues arising from the negotiations to the Chief Technical Advisor CFTA Support Unit for the periodic reports of the activities of the Unit, and ensure that agreed deadlines for these inputs are strictly adhered to; and
• Perform any other related duties as may be assigned by the Chief Technical Advisor CFTA Support Unit or the Director of Industry and Trade.
3. Education Qualifications and Experience
• Candidates must have a University Degree in law, economics, international trade, international trade law or another appropriate related discipline. A candidate with a non-legal first degree must have a higher post-graduate legal degree (preferably in international trade law), or an additional professional legal post-graduate diploma. For candidates with a first degree in law, an additional post-graduate legal qualification will be required.
• Candidates must have had at least eight (12) years of progressively responsible professional experience as a negotiator or legal advisor in regional integration or trade negotiations. At least five (7) years of this experience should have been in support of – or within – a national, regional, continental, or international organization, and should have involved the negotiation of legal provisions or other legal issues or the provision of legal advice to the negotiators involved.
• Candidates with University Bachelor Degree can be considered provided they have 15 years of relevant work experience out of which 5 must be at managerial level.
4. Other Relevant Skills
• Candidates must be computer literate (Microsoft Office Suite).
• Candidates must have excellent interpersonal skills, the ability to organize and motivate others and to work in a multi-cultural environment.
• Candidates must have good planning, organizational and reporting skills.
5. Language Requirement
Working proficiency in one of the African Union working languages is a requirement. Proficiency in one or several of the African Union’s other working languages would be an added advantage.
6. Tenure of Appointment
The appointment will be made on fixed term contract for a period of one (1) year of which the first three months will be considered as probationary period. A further one year contract may be offered subject to the requirements of the negotiations and satisfactory performance and deliverables. An additional one year extension thereafter may be possible should the negotiations require this, the funding availability and subject to the incumbent’s satisfactory performance and deliverables.

7. Remuneration
The salary attached to the position is an annual lump-sum of US$110,107.14 inclusive of all allowances for internationally recruited staff and US$ 98,501.89 inclusive of all allowances for locally recruited staff.
